Agreement
In plain terms
These terms are the contract between you and us when you use Traguardo. Using the app means you accept them.
The free, local mode costs nothing. Premium is a paid subscription billed by Apple that renews automatically until you cancel.
These Terms of Use ("Terms") form a binding agreement between you and Filip Růžička (trading as frose.io), Czech Republic ("we", "us"), governing your use of the Traguardo application and related services (the "Service"). If you don't agree with these Terms, please don't use the Service.
Your privacy is covered separately in our Privacy Policy, which is part of this agreement.

The service
Traguardo is a task manager and daily planner for Apple devices. It helps you capture tasks, organise projects, build mindmaps, plan your day, and — with a premium subscription — sync across devices and use AI-assisted features. We work to keep the Service available and reliable, but we may change, add, or remove features over time.

Eligibility & accounts
You may use the local mode with no account. To sync and use premium features, you create an account with email and password or with Sign in with Apple. You must be at least 16 years old to use the Service.
- You're responsible for keeping your login credentials secure and for activity under your account.
- Provide accurate information, and let us know promptly if you suspect unauthorised access.
- Accounts with a password use email-based two-factor authentication to help protect you.

Licence to use
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Traguardo on devices you own or control, for your own personal or internal business use. This licence is limited to the Service as we provide it — we retain all rights, title and interest in the app, its software, design and trademarks.

Free & Premium
- Free (local) mode is free to use. It works entirely on your device, with no account and no cloud sync. There's no charge, ever, for using Traguardo this way.
- Premium is a paid subscription. It unlocks cross-device sync, Apple Watch, attachments, and the AI features. Premium requires an account.
We may offer a free trial for Premium. Unless you cancel before the trial ends, it converts into a paid subscription automatically (see below).

Subscriptions & auto-renewal
The important part about billing
Premium subscriptions are sold and billed by Apple through your App Store account, not directly by us. Payment is charged to your Apple ID at confirmation of purchase.
Subscriptions renew automatically for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
You can view, manage, or cancel your subscription and turn off auto-renewal any time in your Apple ID settings on your device. Deleting the app does not cancel your subscription.
Prices may vary by region and can change; we'll give notice of price changes as required, and existing subscribers may keep their current price where applicable. Because Apple processes payment, refunds are handled by Apple under the App Store's terms — we generally cannot issue them directly. We use RevenueCat only to confirm your subscription status; we never receive your payment card details.

Acceptable use
Use Traguardo lawfully and reasonably. You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the app, except where the law expressly permits it.
- Abuse, overload, or attempt to disrupt the Service or its infrastructure, or circumvent usage limits or security measures.
- Misuse the AI features — for example by submitting unlawful, abusive, or infringing content, or by using them to generate harmful material or to attack the underlying models.
- Use the Service to store or transmit content that's illegal or that infringes someone else's rights.
- Access the Service through automated means in a way that harms it, or resell or redistribute it without our permission.
We may suspend or limit access if use threatens the Service or other users.

AI features
Premium AI features process the text or images you submit to produce suggestions — such as parsing natural language into tasks, breaking tasks down, reading a photo, or drafting a briefing. AI output can be inaccurate or incomplete; treat it as a helpful draft, not authoritative advice, and review anything important before you rely on it. How the underlying processing works is described in our Privacy Policy.

Your content
Your content stays yours. The tasks, projects, mindmaps, notes and attachments you create belong to you. We claim no ownership over them.
To operate the Service, you grant us a limited licence to host, store, back up, transmit and process your content solely as needed to provide the features you use — for example, to sync your data across your devices or to return an AI result you requested. This licence exists only to run the Service for you and ends when you delete the content or your account. You're responsible for your content and for having the right to use it.

Third parties & Apple
The Service relies on third-party providers (such as Apple, DigitalOcean, RevenueCat, Anthropic, Resend, Google and Sentry), each covered in our Privacy Policy. Your use of their services may also be subject to their own terms.
Apple standard EULA. Because Traguardo is distributed through the App Store, these Terms apply together with Apple's standard Licensed Application End User License Agreement (EULA). Where these Terms and Apple's standard EULA conflict for the licensed application, Apple's standard EULA governs to the extent of that conflict. Apple is not responsible for the Service or for support, and Apple is a third-party beneficiary of these Terms entitled to enforce them against you.

Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your requirements, or that your data will always be available. You use the Service at your own discretion and risk, and you're responsible for keeping your own backups where it matters to you.

Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of (or inability to use) the Service.
To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us (or Apple, for Traguardo) in the 12 months before the claim, or EUR 50. Nothing in these Terms limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

Termination
You can stop using Traguardo at any time and delete your account in the app, which removes your data as described in the Privacy Policy. We may suspend or terminate your access if you materially breach these Terms or misuse the Service. Sections that by their nature should survive termination — such as content licences you granted, disclaimers, limitation of liability, and governing law — continue to apply.

Changes to these terms
We may update these Terms from time to time. When we do, we'll update the effective date at the top, and for material changes we'll give notice in the app or by email. If you keep using the Service after a change takes effect, you accept the updated Terms. If you don't agree, please stop using the Service.

Governing law
These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-laws rules, and the courts of the Czech Republic have jurisdiction over any dispute — except where mandatory consumer-protection law in your country of residence gives you the right to bring a claim locally or entitles you to the protection of your local law. Nothing here removes statutory rights you have as a consumer.
